This agreement is between Pounds Puppies Poodles (Seller) and __________________ (Buyer) as noted below and is entered to on ___________ (date). Hereinafter the puppy mentioned below in the table will be noted as Puppy. It is agreed between and Seller and Buyer as follows:

Here at Pounds Puppies Poodles we try to include as many details as possible in our Health Guarantee as to what is covered and what is not covered. This is a legally binding contract between Pounds Puppies Poodles (Seller) and you (Buyer), this is for your protection, our protection and most importantly the puppy’s protection.

Conditions of Sale: Seller guarantees that at the time of delivery/pickup, the puppy is in good health and has been vaccinated and dewormed properly for the present age. It has been thoroughly examined by our vet from nose to tail and if he finds a problem it will be reported to you before you get the puppy. Seller will provide accurate health records of the puppy to the Buyer. Because over vaccinations can cause serious health consequences, any vaccination given before your puppy is actually due for its next vaccine will void this Health Guarantee in its entirety.

The Buyer has three (3) days from the time of receipt of the puppy to have the puppy examined by a licensed veterinarian. This Health Guarantee will be terminated if the puppy is not examined within the 3 day period. Should your vet find the puppy to have a serious life-threatening congenital illness or disease, you must notify Seller within 24 hours. Puppy must be returned and accompanied with documented proof of illness from licensed veterinarian within seven (7) days of purchase. Seller will not be responsible for any transportation costs and vet expenses. Seller reserves the right to have the puppy examined by a licensed veterinarian of its choice to verify diagnosis before replacing. Replacement puppy will be of similar value to original puppy. No refunds or replacements will be given if you surrender the puppy to Seller for non-health related reasons.

The puppy is guaranteed to the original Buyer for one (1) year against hereditary/genetic disease. If the puppy is found to have a serious hereditary/genetic disease a puppy of equal value will replace the original puppy when available within 12 months. If the puppy dies of a hereditary/genetic disease the Buyer must have a necropsy performed at their state lab and provide a report proving the hereditary/genetic disease. Failure to comply will result in no replacement or compensation of any sort. It is understood that Seller is never responsible for cost of veterinarian exam, necropsy or transportation cost.

It is required that you find a licensed veterinarian to keep the puppy up to date on vaccinations, deworming, regular exams and any health issues. At first sign of puppy distress or illness the Buyer must take puppy to a licensed veterinarian and notify Seller if serious. Stress induced illnesses such as hypoglycemia, colds, allergies, diarrhea or protozoan type parasites such as coccidia or giardia from traveling stress or transitioning are not covered under the Health Guarantee, nor are genetic conditions that are not life threatening. Any costs associated with veterinary care and transportation are always the exclusive responsibility of the Buyer.

Buyer agrees to keep the puppy in good physical condition with regularly scheduled vaccinations, deworming, flea, tick and heart worm prevention. The Buyer is to provide proper shelter, exercise, fresh water, a high-quality food, treats, pet care products and nutritional supplements as needed. It is imperative to your dog’s nutritional health, proper development and overall well-being that you feed a high-quality food. The Seller cannot ensure the overall health of the puppy if it is provided poor nutrition and is allowed to consume harmful preservatives and chemicals.

Please wait until you have had your puppy for one week before adding a new vaccination. Puppies can get parvo from other dogs or in the ground where other infected dogs have pooped. Parvo is most common in puppies two (2) to six (6) months old can be fatal. Most of our puppies can leave here at 8-9 weeks old. This means that they do not have full immunity. As such, please be careful not to expose them to things like other animals, public ground such as airport, rest areas, grass, dirt, floor at vet’s office, dog parks, pet stores, gas stations etc. Assume every dog at the vet is sick. Assume every surface at the vets office is contaminated. Do not touch other dogs and do not let strangers touch your dog. Even the people’s hands can have parvo on them. Ask if the table and scales have been sanitized. If the scale has not been sanitized, please ask for it to be cleaned or to apply a protective sheet to the scale.

This Health Guarantee does NOT cover any cost associated with spay or neutering, nor does it cover injury or death from any routine surgical procedure. Further, this Health Guarantee does not cover any of the following conditions or minor flaws: worms, coccidiosis, giardia, hypoglycemia, kennel cough, pre-pneumonia, ear mites, ear infections, skin mites, mange (sarcastic demodectic or cheyletiella), cherry eye or any other non-life-threatening skin or tissue issues, allergies, over or under bite, herniations, a non-life-threatening open fontanel. This guarantee does not cover any non-life-threatening bone or joint disorder such as but not limited to luxating patellas and heart murmurs that are non-life-threatening.  Seller cannot guarantee size, color, temperament, or fertility (including presence of testicles) of the puppy. Seller cannot guarantee size or confirmation and does not imply or intend to imply any potential and/or prospect of show quality of any puppy. In addition, Seller cannot guarantee that dewclaws will not re-grow and will not be responsible for any cost the Buyer may incur in removing dewclaws or tail docking.

Buyer agrees that the puppy will never be sold leased or given to any pet shop, animal shelter, rescue, research laboratory or other similar facility. In the event Buyer decides they can no longer care for the dog, wishes to sell, transfer ownership, give the puppy/dog away, we respectfully request that Seller is given First Right to Refusal. All of our puppies are considered family members, even after they leave us, and we would like the opportunity to continue to care for them in the event your circumstances change.

All puppies are sold as pets (AKC limited registration), unless breeding rights are purchased, and Buyer must agree to spay or neuter before puppy is two years old. Exceptions can be made in certain circumstances but must be approved by Seller. Any puppy purchased that is not sterilized and is found to be used for breeding will be in breach of this contract and is punishable by law and Buyer will be required to pay Seller for breach of contract in the amount of $2,000. Seller has the right to request veterinarian spay or neuter certificate.

Seller assumes no responsibility for the puppy after it leaves the premises, for medical expenses, family disputes or any other problems you have not thought of. Seller does not pay veterinarian bills or transportation costs under any circumstances. Please consider all the pros and cons of adding a puppy to your life before you purchase this new member of your family.

Our Health Guarantee is for hereditary, genetic faults with heart, liver, kidneys, not for stress related issues or accidents. By signing below, Buyer understands the Buyer is responsible for all vet care and understands Seller does not offer any type of reimbursement for this. The maximum Pounds Puppies Poodles will cover on any claim with this Health Guarantee is only up to the price of the puppy. In the event of litigation the venue shall be in Riverside County, CA.
